YouShopAmerica Mailbox Facility

Customer

The Service Agreement is made and entered into by the Customer and American Goodies  for the use of the YouShopAmerica Mailbox Facility. YouShopAmerica Mailbox Facility is provided to the Customer under the terms of this Service Agreement. Amendments to this Service Agreement will be published from time to time by American Goodies  on its web site and the amendments will be considered an integral part of this Service Agreement.

Customer hereby appoints American Goodies  as agent for the receipt of mail and packages for the duration of the YouShopAmerica Mailbox Facility at designated centers.

Customer agrees that the YouShopAmerica Mailbox Facility will not be used for any unlawful, illegitimate or fraudulent purpose or for any purpose prohibited by law in the country where the YouShopAmerica Mailbox Facility is provided.

The Service Agreement will be kept confidential unless requested by any law enforcement or government agency. In such cases American Goodies  will not be held in breach of confidentiality.

American Goodies  is not responsible or accountable for the damage, loss or delivery failure of any package or mail from the vendor prior to arrival at the YouShopAmerica Mailbox Facility.

The Customer agrees not to hold American Goodies , its agents and respective affiliates liable under any circumstances for any special or consequential damages or loss. Special or consequential damages or loss shall include (but not be limited to) commercial and financial loss, special reconstruction costs, substituted costs, loss of interest, profit, income, utility, market or business opportunity, whether or not American Goodies , its Agents or respective affiliates had knowledge that such damages might be incurred.

American Goodies  will be responsible for the Customer’s Mailbox contents only while it is within American Goodies  custody and control. American Goodies  shall not be liable for loss or damage of the Mailbox contents while these contents are out of American Goodies  custody or control. American Goodies  liability is in any event limited to Thirty Dollars (U$D 30/-) or its equivalent per shipment regardless of the nature of the claim.

The Customer agrees to protect, indemnify and hold American Goodies  and its officers, agents and employees from and against any and all losses, damages, expenses, claims, demand, liabilities, judgments, settlements, costs and causes of action of every type and character arising out of or in conjunction with the use of the YouShopAmerica Mailbox Facility or the contents received and shipped on the Customers behalf. The actions of any person authorized by Customer to use the Mailbox or the Service will be attributed to Customer

American Goodies  will not accept C.O.D. (Cash on Delivery) packages unless the customer pre-arranges with American Goodies  and pays for the C.O.D charges in advance.

American Goodies  shall accept certified, registered, insured or express mail on the Customer’s behalf. In consideration for this Service and the substantial responsibilities involved therein, the Customer expressly releases American Goodies  from all responsibility for loss, damage or other disposition of such mail. In accordance with this release, the Customer further waives any and all rights of claim against American Goodies  in respect to such mail.

Customer is obligated to provide American Goodies  with Export Declaration Documentation (packages originating in the United States of America) exceeding U$D 2,500/- in value prior to package being shipped to requested country.

Customer agrees to pay American Goodies  a non-refundable setup fee of USD 15.00 for the YouShopAmerica Mailbox Facility.

Shipping fees will be charged as per the rates set forth on the Website "Shipping Rates" The Shipping Fees are inclusive of all local airport taxes, but exclusive of any value added taxes, customs duties, levies and other official charges incurred due to the import or carriage of the Customer’s goods. American Goodies  will not be liable for any penalties imposed or loss or damage incurred due to the Customer’s documents or goods being impounded by customs or similar authorities and the Customer hereby indemnifies American Goodies  against such penalty or loss.

The Mailbox Fee, Shipping Fees and any other related charges stated herein or incidental hereto are subject to change. In the event that Customer receives an unreasonable amount of mail or packages according to American Goodies  reasonable judgment, American Goodies  may require the Customer to increase the shipment frequency.

Customer agrees that American Goodies  may hold mail and packages pending payment. There will be no refunds for cancellation of any service.

American Goodies  reserves the right to terminate or cancel the YouShopAmerica Mailbox Facility in the following cases:
Customer uses the Mailbox for unlawful, illegitimate, or fraudulent purposes;
Customer’s violation of any provision of this Service Agreement
Customer’s receipt of an unreasonable volume of mail or packages and refusal to increase shipping frequency.

Notwithstanding the above statement, American Goodies  is only responsible for shipping packages that have the same name of the individual or entity stated on the Application Form. For packages received to a mailbox which does not match the corresponding name on the Application Form, American Goodies , at its sole discretion, may choose not to send the packages.

Customer may terminate the Service Agreement by deciding not to renew subscription by providing American Goodies  with 30 days written notice. American Goodies  reserves the right to refuse to accept any mail and/or package delivered to Customer’s Mailbox after the termination date.

This Agreement shall be construed and interpreted in accordance with the laws of the state where the Mailbox is located.
